The internet shop Pachniolek available at www.pachniolek.pl is run by ROYAL COMPANY Sp. z o.o, entered into the register of enterpreneurs kept by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, under NCR number: 0000628044. The terms used in Terms and conditions should be understood as follows:
1. Client – a natural person, a legal person or an organizational unit without legal personality; to whom special ruling acknowledge legal capacity, who places an order in the Shop;
2. Civil Code – the Civil Code Act dated 23 April 1964 (Journal of Laws, No. 16 item 93, as amended)
3. Terms and Conditions – these Terms of Service as part of an www.pachniolek.pl
4. An online boutique (Shop) – a web site available at www.pachniolek.pl, via which a Client may place orders;
5. Goods – products presented in the Online Shop;
6. Sale agreement – agreement for the sale of items as defined in the Civil Code, contracted between ROYAL COMPANY Sp. z o.o, ul. Wałbrzyska 11/253A, 02-739 Warszawa and a Client; concluded with the use of the web site of the Shop;
7. Act on specific terms and conditions of consumer sale – the Act dated 27July 2002 on specific terms and conditions of consumer sale and amendments to the Civil Code (Journal of Laws No. 141 item 1176, as amended).
8. Act on Rendering Electronic Services – the Act dated 18 July 2002 on rendering electronic services (Journal of Laws No. 144 item 1204, as amended)
9. An Order – a Client’s declaration of will aiming to a sale agreement, especially defining type and the quantity of items
II. General Provisions
2.1 There Terms and Conditions define the rules of using the online boutique available at www.pachniolek.pl.
2.2 These Terms and Conditions are terms and conditions referred to in art 8 of Act on Rendering Electronic Services.
2.3 The online shop available at www.pachniolek.pl is run by ROYAL COMPANY Sp. z o.o, ul Wałbrzyska 11/253A, 02-739 Warszawa.
2.4 These terms and Conditions define in particular:
a) Rules to register and use an account on the online boutique;
b) Terms and conditions of electronic reservation of items available in the online boutique;
c) Terms and conditions of placing online Orders as part of the online boutique;
d) Rules of conclusion of Sale Agreement using services provided by the online boutique.
2.5 Using the online shop is possible if a Client’s ICT system meets the following technical requirements:
a) Internet Explorer 9.0.8
b) Chrome 23.0.1271.64 m
c) Minimum screen resolution 1280 x 800 pixels
2.6 In order to use the online boutique, a Client should provide the Internet access on his own.
2.7 According to regulations as in force, ROYAL COMPANY Sp. z o.o reserves the right to limit services via the online Shop to adults. In such a case, potential Clients will be notified about the above-mentioned changes.
2.8 Clients may have access to these Terms and Conditions at any moment via the link on the home page at www.pachniolek.pl, download and print it.
2.9 Information about Items provided on the websites of the Shop, especially their description, technical and performance parameters and prices are an invitation to conclude an agreement, within the meaning of art 71 of the Civil Code.
3.1 In order to use the online Shop, a Client is obliged to register on the webpage.
3.2 Registration is understood as filling up the registration form available on one of the webpages.
3.3 Acceptance of conditions of the registration form and filling up the necessary personal data are registration conditions.
3.4 ROYAL COMPANY Sp. z o.o may deprive a Client of the right to use the online Boutique as well as limit a Client’s access to the store of the Boutique as a whole or partly, with immediate effect in case when a Client contravenes the Terms and Conditions, specifically including:
a) during the registration filled up untrue, imprecise or out of date data, misinforming or breaching the rights of the third parties.
b) via the online Shop violated the personality rights of the third parties, especially the personality rights of other Clients of the online shop,
c) perpetrates other activities which ROYAL COMPANY Sp. z o.o finds at variance with applicable laws or general conditions of the use of the Internet or compromising the company’s reputation,
3.5 A person deprived of the right to use the online shop cannot register again without the company’s prior consent.
3.6 In order to provide messages and data transmission safety owing to services, the online Shop take technical and organizational measures appropriate to the degree of threat to services security, especially measures preventing acquirement and modification of personal data transferred via the Internet by unauthorized persons.
3.7 A Client is especially obliged to:
a) not to provide and transmit content banned by the law, e.g. propagating violence, defaming, breaching the personal and other rights of the third parties,
b) use the online Shop without disrupting its functioning, especially by using specific software or devices,
c) not to take actions such as: sending or placing unsolicited advertising (spam),
d) to use the online Shop in a non-disruptive way for other Clients and ROYAL COMPANY Sp. z o.o,
e) to use content placed on the webpage only within the scope of own personal use,
f) to use the online Shop pursuant to the law of the Republic of Poland, the Terms and Conditions and the General Conditions of the Use of the Internet.
IV. Purchase Agreement Procedure
4.1 In order to conclude the Purchase Agreement via the online Shop, a Client should go to the webpage www.pachniolek.pl, choose the items, its specificity and follow the messages and information available on the webpage.
4.2 The choice of items is made by adding to the shopping cart.
4.3 When placing the order – till the moment when a Client clicks ‘Order’ button - a Client may modify own data and item which wants to choose. For this purpose, one should follow the messages and information displayed on the webpage.
4.4 When necessary data are provided by the online Shop user, an order summary will be displayed. It will contain information about:
a) subject of an order
b) product unit and total price of ordered items or services, including delivery price and additional costs (if any)
c) chosen method of payment
d) chosen method of delivery
e) order delivery date
4.5 In order to send an order, it is necessary to accept the Terms and Conditions, provide the necessary data and click ‘Order’ button.
4.6 Placing an order by a Client means a declaration of will of Purchase Agreement made with ROYAL COMPANY Sp. z o.o in accordance with the Terms and Conditions.
4.7 After placing an order, a Client receives an e-mail entitled pachniolek.pl – confirmation of an order (no. ), including final confirmation of all essential elements of Order.
4.8 An Agreement is concluded when a Client receives the above-mentioned e-mail.
4.9 The Purchase Agreement is concluded in Polish in accordance with the Terms and Conditions.
V. Claim of defect
5.1 ROYAL COMPANY Sp. z o.o as a seller is responsible towards a Client who is a customer, as defined in art 22 of the Civil Code, for nonconformity of goods with agreement in respect defined by Act on specific terms and conditions of consumer sale.
5.2 Complaints arising from breaching of a Client’s rights guaranteed by law or on the base of these Terms and Conditions, should be sent at firstname.lastname@example.org. ROYAL COMPANY Sp. z o.o commits itself to investigate complaints within 14 days, however, if it is not possible, the company will inform a Client when a complaint will be investigated.
5.3 ROYAL COMPANY Sp. z o.o is not a producer of goods. The producer is responsible for the guarantee of Goods on the terms and during the period of time set forth in the guarantee card. If the guaranteed card provides for such a possibility, a Client may submit a claim within the guarantee directly in an authorized service (address in the guarantee card).
VI. Claim on rendering electronic services
6.1 ROYAL COMPANY Sp. z o.o takes actions to provide proper functioning of the Shop by using current technical knowledge. The company agrees to remove all irregularities reported by a Client within a reasonable time.
6.2 A Client is obliged to immediately inform ROYAL COMPANY Sp. z o.o about all irregularities or the online Shop system functioning interruption.
6.3 Irregularities connected with the Online Shop functioning may be reported in writing to the address: ul. Wałbrzyska 11/253A, 02-739 Warszawa, e-mail: email@example.com or via a contact form.
6.4 A complaint should contain a Client’s name, surname, a correspondence address, type and a date of irregularity occurrence.
6.5 ROYAL COMPANY Sp. z o.o agrees to investigate each complain within 14 days, however, if it is not possible, the company will inform a Client when a complaint will be investigated.
VII. Final provisions
7.1 Settlement of potential disputes between ROYAL COMPANY Sp. z o.o and a Client who is a customer, as defined in art 22 of the Civil Code, is resolved by competent courts in accordance with the decisions of appropriate provisions of the Code of Civil Procedure.
7.2 Settlement of potential disputes between ROYAL COMPANY Sp. z o.o and a Client who is a customer, as defined in art 22 of the Civil Code, is resolved by a competent court on the grounds of the registered office of ROYAL COMPANY Sp. z o.o.
7.3 To all matters not settled herein provisions of the Civil Code, Act on Rendering Electronic Services, appropriate provisions of Polish law shall apply.
